1. Acceptance of Terms

By creating an account or using OurFamilyRoutine ("the Service"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service. The Service is provided by OurFamilyRoutine and is intended for personal, non-commercial wellness tracking.

2. Description of Service

OurFamilyRoutine is a family wellness and management platform that includes shared calendars, meal logging with AI-powered calorie estimation, workout tracking, daily journaling, habit tracking, health logging, social features, and motivational tools. The Service uses artificial intelligence (AI) and large language models (LLMs) to provide features such as calorie estimation, workout analysis, daily encouragement, nutritional advice, and daily inspiration.

3. Account Registration

You must provide accurate and complete information when registering. You are responsible for maintaining the security of your account credentials and for all activities under your account. You must be at least 13 years old to use the Service. If you are under 18, you must have parental consent.

4. Subscription and Billing

The Service offers a 7-day free trial. After the trial, a subscription of $9.99 per month is required for continued access. Subscriptions are billed monthly through Base44 Payments (powered by Wix) until cancelled. You may cancel at any time and will retain access until the end of the current billing period.

Each subscription includes a monthly allowance of AI/integration credits. If you exhaust your monthly allowance, you may purchase additional credit packs. Credits are non-refundable. Pricing and credit allowances may change with reasonable notice.

5. AI-Powered Features and Limitations

The Service uses AI and LLMs to generate responses including calorie estimates, workout analysis, motivational messages, and nutritional suggestions. AI-generated content may be inaccurate, incomplete, or inappropriate. You should always verify AI-generated information independently. The Service does not guarantee the accuracy or reliability of any AI-generated content.

6. No Medical or Health Advice

The Service is not a medical device and does not provide medical, psychological, or professional health advice. We are not doctors, dieticians, or licensed healthcare professionals. All calorie estimates, workout recommendations, nutritional suggestions, and wellness insights are for informational and motivational purposes only. Any dietary or medical advice, suggestions, or recommendations presented by the Service—including AI-generated nutritional guidance, calorie estimates, and workout analysis—should be followed solely at your own discretion.

Always consult a qualified healthcare professional or registered dietitian before making changes to your diet, exercise routine, or wellness regimen, particularly if you have medical conditions, allergies, or dietary restrictions. Never disregard professional medical advice or delay seeking it because of something you read on this Service.

7. User Content

You retain ownership of all content you submit to the Service, including meal logs, workout logs, journal entries, photos, and profile information. You grant the Service a license to use your content solely for operating and improving the features available to you. You are responsible for the accuracy and legality of content you submit.

8. Acceptable Use

You agree not to: (a) use the Service for any unlawful purpose; (b) harass, abuse, or harm other users; (c) upload malware or harmful code; (d) attempt to access data or systems without authorization; (e) reverse engineer or scrape the Service; or (f) use the Service in a way that could damage or impair its functionality.

9. Limitation of Liability

To the maximum extent permitted by law, the Service and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or health outcomes, arising from your use of or inability to use the Service. The Service is provided "as is" and "as available" without warranties of any kind, express or implied. You use the Service at your own risk.

The Service does not warrant that it will be uninterrupted, error-free, or secure. Any reliance on AI-generated content or wellness data is at your own risk.

10. Indemnification

You agree to indemnify and hold harmless the Service and its operators from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

11. Third-Party Services

The Service integrates with third-party providers including Google (authentication), Wix/Base44 Payments (billing), and Oura (biometric data). These third parties have their own terms and privacy policies. The Service is not responsible for the practices of third-party providers.

12. Termination

You may delete your account at any time. The Service reserves the right to suspend or terminate accounts that violate these Terms or for any other reason at its discretion. Upon termination, your right to use the Service ceases immediately.

13. Changes to Terms

We may update these Terms from time to time. We will notify users of significant changes. Continued use of the Service after changes constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by applicable laws without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration where permitted by law.
